Taxation of the private individuals
The advice and representation of individuals in income tax matters begins with the question of tax liability in Germany (unlimited/limited). In this context, we advise on the tax consequences of individuals departing from or moving to Germany. Furthermore, we deal with questions of current taxation, in particular with regard to employee taxation, capital gains and income from renting and leasing. A regular question is also whether an economically relevant case is subject to domestic taxation at all or not (e.g. in the case of real estate sales and speculative transactions, the distinction from "Liebhaberei" (hobby) or the recognition of losses). In addition, we advise shareholders and managing directors of corporations on all relevant issues of corporate law and tax law. A bone of contention with the tax authorities in this context is, for example, the reclassification of income from renting and leasing as business income due to the assumption of a business split. Here we support our clients both in avoiding a business split and in avoiding the unintended dissolution of a business split.
